Summary
Virginia law allowing or requiring schools to stock emergency supplies of epinephrine auto-injectors for students experiencing anaphylaxis.
Full Description
Virginia has enacted a school stock epinephrine law that allows or requires schools to maintain emergency supplies of undesignated epinephrine auto-injectors. These laws permit trained school personnel to administer epinephrine to any student believed to be experiencing an anaphylactic reaction, including students who do not have their own prescribed epinephrine. This is critical because approximately 25% of anaphylaxis reactions at school occur in students previously undiagnosed with a severe allergy. The federal School Access to Emergency Epinephrine Act (2013) incentivized states to pass these laws by providing grant preferences.
Key Provisions
Local school boards may develop and implement policies for the possession and administration of auto-injectable epinephrine by a school nurse or an employee authorized and trained in the administration of epinephrine auto-injectors. The policies may authorize a school nurse or trained employee to provide auto-injectable epinephrine to a student with a prescription on file, and to administer auto-injectable epinephrine to any student believed to be having an anaphylactic reaction in accordance with a protocol developed by the Board of Medicine and the Board of Nursing. Pursuant to a standing protocol developed by the Board of Medicine, a physician may issue a prescription to a local school board for auto-injectable epinephrine. A school nurse may possess and administer auto-injectable epinephrine pursuant to a standing protocol developed by the Board of Medicine and the Board of Nursing.
