Summary
Federal law incentivizing states to allow schools to stock epinephrine auto-injectors for emergency use.
Full Description
The School Access to Emergency Epinephrine Act was signed into law on November 13, 2013. The law gives states that require schools to maintain a supply of epinephrine auto-injectors and permit trained school personnel to administer epinephrine to any student believed to be having an anaphylactic reaction a preference for federal asthma-related grants. This incentive led to many states passing stock epinephrine laws in the years following its enactment. The law was named in memory of children who died from anaphylaxis at school, and was championed by Food Allergy Research & Education (FARE) and the Allergy & Asthma Network.
Key Provisions
1. Provides federal grant preferences to states with stock epinephrine laws. 2. Encourages schools to maintain emergency epinephrine supplies. 3. Permits trained personnel to administer epinephrine to any student in anaphylaxis. 4. Does not preempt state law.
